1. Acceptance of Terms

By accessing and using The Legacy Trek ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

The Legacy Trek is an Artificial Intelligence-powered platform designed to help users document personal histories, family stories, and ancestral memoirs. The Service provides:

  • Personal History Builder — guided memoir writing from your own life experiences
  • Roots Chronicles — multi-generational family story creation with research assistance
  • Eulogy Writer — guided tribute creation for loved ones
  • Artificial Intelligence-powered story generation, PDF export, and audiobook creation

The Legacy Trek is a product of Havari and is an independent service. It is not affiliated with, endorsed by, or officially connected to FamilySearch, FamilySearch International, or The Church of Jesus Christ of Latter-day Saints.

3. User Accounts

The Legacy Trek requires account registration to save and manage your projects. You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity that occurs under your account
  • Providing accurate information when creating your account
  • Using the Service in a manner consistent with its intended purpose

4. Your Content

You retain ownership of all content you submit to The Legacy Trek, including text responses, uploaded photos, documents, and generated stories. By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service (e.g., generating your memoir, creating PDF exports, producing audiobooks).

We do not claim ownership of your stories, memories, or family history content. Your stories are yours.

5. Software-Generated Content

The Legacy Trek uses artificial intelligence to help craft narratives from your responses. Please note:

  • Software-generated stories are based on the information you provide and may include creative embellishment
  • Historical context woven into stories is generated by Artificial Intelligence software and should be verified for accuracy
  • You can edit all generated content before finalizing
  • Responses from the Virtual Family History Consultant provide general research guidance, not professional genealogical advice
  • The software is not a substitute for professional research or historical verification

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Upload harmful, offensive, or illegal content
  • Attempt to gain unauthorized access to any portion of the Service
  • Interfere with or disrupt the Service or servers
  • Use automated systems (bots, scrapers) to access the Service
  • Harass, abuse, or harm other users

7. Intellectual Property

The platform design, code, graphics, logos, and other materials on The Legacy Trek are owned by Havari and are protected by copyright and intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our platform without prior written permission.

8. FamilySearch Integration

The Legacy Trek offers an optional connection to FamilySearch.org that allows you to browse your family tree and import ancestor data directly into your Roots Chronicles project. The following applies to this integration:

What We Access & Store

  • Your FamilySearch login credentials are never seen or stored by us. You log in directly through FamilySearch's own secure login page.
  • FamilySearch issues a temporary access token to Legacy Trek on your behalf. This token is stored only for the duration of your active session and is never saved to our database. When your session ends, the token is gone.
  • Your FamilySearch Person ID may be stored to identify your family tree connection.
  • When you choose to import ancestor data — such as names, dates, places, written memories, and portrait photos — that information is stored in your Legacy Trek project on our servers. This is the same data you entered or approved on FamilySearch and is your own family history.

Your Responsibility

  • Your use of FamilySearch through Legacy Trek is governed by FamilySearch's own Terms of Service. We are not affiliated with, endorsed by, or officially connected to FamilySearch International or The Church of Jesus Christ of Latter-day Saints.
  • You are responsible for ensuring that your use of your family history data complies with FamilySearch's terms and any applicable privacy considerations for living individuals.

Third-Party Services Generally

Your use of any third-party service referenced or linked from Legacy Trek is governed by that service's own terms and privacy policy. We are not responsible for the content, policies, or practices of third-party services.

9. Data Storage & Backups

We take reasonable steps to protect your data and maintain continuity of service:

  • Server Backups: We run automated database backups every 6 hours, retained on a secure server. These allow us to recover data in many situations.
  • Offsite Backups: We maintain hourly code and data backups to a private offsite repository as an additional layer of protection.
  • Admin Recovery: In the event of accidental data loss, our administrator can access your project data solely for the purpose of recovery. This access is limited, logged, and used only to help you — never to read, share, or use your personal content.

Despite these measures, no backup system is perfect. Server failures, human error, or other unforeseen events can result in data loss. We do our best — but we cannot guarantee against all scenarios.

10. Your Responsibility to Back Up Your Content

We strongly recommend that you regularly download and save your stories to your own device. Do not rely solely on Legacy Trek as your only copy of your family history content.

  • Use the Download or Export options available in the Editor and Publish sections to save your memoir as a PDF or document to your local machine.
  • Treat your downloaded copy as your permanent personal archive — one that exists independently of this platform.
  • If you delete a project, it is your responsibility to ensure you have saved a local copy first. Deleted projects are moved to your account trash and can be recovered, but we recommend not relying on that as your primary backup.

Your family history is irreplaceable. Please protect it.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

  • We make no guarantees regarding the accuracy of software-generated content
  • We make no guarantees regarding the accuracy of historical context included in stories
  • While we maintain automated backups and take reasonable precautions, we cannot guarantee against all data loss scenarios — which is why we strongly encourage you to keep your own local copies

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE LEGACY TREK, HAVARI, AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

13. Children's Use

The Legacy Trek is designed for users ages 12 and older. Children under 13 should use the Service only with a parent or guardian present. We do not knowingly collect personal information from children under 13 without parental consent.

14. Cookies & Privacy

The Legacy Trek uses cookies and sessions to provide the Service. By using our site, you consent to the use of these technologies as described below.

What We Use

  • Session Cookies: Essential for login authentication and navigating the site
  • CSRF Tokens: Security tokens to protect form submissions
  • User Data: Your responses, uploaded photos, and documents are stored on our servers linked to your account

What We Don't Do

  • We do not use advertising or tracking cookies
  • We do not sell your data to third parties
  • We do not share your personal stories or family history with anyone
  • We do not use your content to train Artificial Intelligence models

15. Subscriptions & Payments

Legacy Trek offers both free and paid subscription tiers. By subscribing to a paid plan, you agree to the following:

  • Billing: Subscriptions are billed monthly or annually depending on your selected plan
  • Automatic Renewal: Subscriptions automatically renew unless cancelled before the renewal date
  • Refunds: We offer a 3-day money-back guarantee on new subscriptions. After 3 days, payments are non-refundable
  • Price Changes: We may change subscription prices with 30 days notice to existing subscribers

What Happens If You Cancel or Stop Paying

  • Your account remains active and you can still log in
  • You retain read-only access to all your existing projects and stories
  • You cannot create new projects or generate new content without an active subscription
  • Your data is never deleted simply because you stopped paying — it stays safe until you choose to delete it
  • You can resubscribe at any time to regain full access

16. Data Retention

We retain your data as follows:

  • Active Accounts: Your stories, photos, documents, and account information are retained indefinitely while your account exists
  • Cancelled Subscriptions: Your data is retained even after subscription cancellation — you never lose your stories because you stopped paying
  • Deleted Projects: When you delete a project it is moved to your account trash. It remains recoverable until you permanently delete it from trash or delete your account entirely
  • Inactive Accounts: Accounts with no login activity for 3 years may be flagged for review. We will attempt to contact you via email before taking any action
  • Deleted Accounts: When you delete your account, all data including trash is permanently removed within 30 days and cannot be recovered

We do not hold your data hostage. Your family stories belong to you, not us.

17. Account & Data Deletion

You have the right to delete your account and all associated data at any time.

How to Delete Your Account

  • Go to Account Settings from the menu
  • Scroll to the Danger Zone section
  • Click "Delete My Account" and follow the confirmation steps

What Gets Deleted

  • All your projects (Personal History, Roots Chronicles, Eulogy)
  • All uploaded photos and documents
  • All generated stories, PDFs, and audio files
  • Your account credentials and personal information

This action is permanent and cannot be undone. We recommend downloading or exporting your content before deleting your account.

18. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes are posted constitutes acceptance of the modified terms.

  • I understand that it is my responsibility to regularly download and save my content to my own device. I will not rely solely on Legacy Trek as the only copy of my family history.
  • I understand that if I delete a project it is moved to my account trash, and that permanently deleting it or deleting my account will result in data that cannot be recovered.
  • I understand that if I connect a FamilySearch account, any data I choose to import is my own family history and that FamilySearch's own Terms of Service govern my use of their platform.
  • I understand that Legacy Trek's administrator may access my project data solely for the purpose of assisting with data recovery, and for no other purpose.
  • I accept these conditions and take personal responsibility for maintaining my own local backups of my content.
